Gujarat High Court Denies Anticipatory Bail in Rape and Blackmail Case

The Gujarat High Court has recently rejected anticipatory bail applications filed by three individuals implicated in a case of rape and blackmail that involves allegations of video evidence. Justice Sanjeev J. Thaker, in an order dated October 8, 2026, ruled that the allegations against each applicant were specific and warranted a proper investigation, thus denying them the requested relief.

The case centers around a woman who has accused the three men of not only rape but also repeated molestation and threats, including the alleged recording of the sexual assault. The court noted that the mobile phone purportedly containing the incriminating video had not yet been recovered, which is crucial for the ongoing investigation.

In the court's view, the dignity of a woman must not be compromised through force, threats, or fear, and thus the allegations must be thoroughly examined. The applications arose from a First Information Report (FIR) filed at Babra Police Station in Amreli district under various sections of the Bharatiya Nyaya Sanhita, 2023.

The accused argued that one of them had been in a consensual relationship with the complainant and had even proposed marriage. They claimed that social circumstances, including caste differences and age gaps, prevented the relationship from progressing. Additionally, they pointed to a significant delay in the filing of the FIR, which they contended was lodged nearly a year after the alleged incidents, suggesting that the allegations were fabricated.

Allegations of Exploitation and Blackmail

However, the prosecution countered that the accused had exploited the complainant's financial vulnerability and acted in concert to perpetrate the alleged offenses. The complainant, who works as a daily-wage laborer, detailed instances of rape and molestation, asserting that one of the accused recorded the incidents on his mobile phone and subsequently used the footage to blackmail her.

The High Court underscored that the allegations were not general in nature and that each accused had a distinct role in the events described. For instance, the first accused was alleged to have forcibly restrained the complainant while the second recorded the incident, and the third was accused of demanding sexual favors under threat of exposing the video.

How The Scheme Worked

The court's decision was informed by precedents set by the Supreme Court regarding anticipatory bail in serious offenses, emphasizing the need to balance individual liberty with the gravity of the allegations and the necessity of a fair investigation. The court also highlighted that the absence of a need for custodial interrogation does not automatically justify the granting of anticipatory bail. Rather, the prima facie nature of the allegations must be thoroughly assessed.

In conclusion, the Gujarat High Court found that the applicants had failed to establish a case for anticipatory bail, given the serious and specific nature of the allegations against them, and thus their applications were dismissed, allowing the investigation to proceed without interference.
